TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIGABITE GAMES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR VIRTUAL ITEMS. OUR TOTAL LIABILITY FOR A CLAIM RELATED TO A SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THAT SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100. This does not limit liability that cannot lawfully be limited.
10. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, except where applicable consumer-protection law requires otherwise.
11. Changes and contact
We may update these Terms as our Services or legal obligations change. We will post the updated Terms here and revise the effective date. Continuing to use a Service after changes take effect means you accept the revised Terms, to the extent permitted by law.
